FOOTBALL: US Court Dismisses Siasia’s Appeal Over FIFA Ban

A United States Court of Appeal in New York has dismissed an appeal brought before it by Samson Siasia, former Super Eagles coach, seeking to overturn his five-year FIFA ban.

In a judgment delivered by a three-member panel on Thursday, the court ruled that Siasia failed to establish why a court in New York had jurisdiction over the case.

It added that the Nigerian failed to establish, in his suit, that FIFA, a body based in Switzerland, was “essentially at home” in New York.

The court also said although Siasia, who is based in the US, was banned from using a coaching licence issued by US soccer, his argument in that regard was not effective and barely supported by “conclusory statements.”

The ruling also affirmed the decision of a New York district court that had earlier dismissed the case on December 29, 2021.

“Upon consideration, it is hereby ordered, adjudged and decreed that the order of the district court entered on December 29, 2021 is affirmed,” the court statement reads.

“This case asks us to decide whether the district court properly dismissed Appellant Siasia’s 5 Complaint for lack of personal jurisdiction over Appellee Fédération Internationale de Football 6 Association (“FIFA”), a Swiss entity. See Siasia v. Fédération Internationale de Football 7 Association, No. 21 Civ. 6516 (AKH), 2021 WL 5042974, at *4 (S.D.N.Y. Oct. 29, 2021).

“We 8 assume the parties’ familiarity with the underlying facts, the procedural history, and the issues on 9 appeal, which we reference only as necessary to explain our decision.

“The record does not support the finding that Siasia made a prima facie showing of personal 6 jurisdiction under either theory. Siasia’s support for general jurisdiction relies on generalized 7 claims and poorly supported speculations of future activity that plainly do not suffice to render 8 FIFA ‘essentially at home’ in New York.”

In 2019, FIFA found Siasia “guilty of having accepted that he would receive bribes in relation to the manipulation of matches”.

The offence, FIFA had said, violated the federation’s code of ethics and consequently pinned a life ban from football-related activities on the multiple Olympic medalist.

The ban was also accompanied by a 50,000 Swiss francs ($54,000) fine.

However, the sanction was reduced to a five-year ban on June 21 at the Court of Arbitration for Sports (CAS).

In August 2021, Siasia sued FIFA over the ban, saying the evidence was “grossly insufficient” and that the punishment violated his due process rights under the U.S. Constitution.

BREAKING: Court Convicts Nnamdi Kanu On Seven Terrorism Charges

The Federal High Court in Abuja on Thursday convicted Nnamdi Kanu, leader of the proscribed Indigenous People of Biafra, on all seven terrorism charges filed against him by the Federal Government.

Justice James Omotosho delivered the judgment and held that Kanu was guilty on each of the counts, which covered allegations of engaging in acts of terrorism, membership and leadership of a proscribed organisation, issuing threats, involvement in attacks that led to the killing of security operatives, destruction and burning of properties, concealment of information, and the importation of an unregistered radio transmitter.

The judge ruled that the prosecution successfully established the allegations presented before the court, leading to the conviction on all seven counts.

BREAKING: Court Convicts Nnamdi Kanu On First Count Of Terrorism

A Federal High Court in Abuja has convicted Nnamdi Kanu, leader of the Indigenous People of Biafra (IPOB), on the first count of seven terrorism charges brought against him.

The judgment was delivered on Thursday by Justice James Omotosho, who presided over the trial. In his ruling, the judge referenced evidence presented by the prosecution, including video interviews in which Kanu made multiple violent threats against Nigeria and its citizens.

The first count pertains to a broadcast Kanu made in September 2021, which prosecutors allege was “with intent to intimidate the population.” During the broadcast, Kanu reportedly threatened that “people would die” and that “the whole world would standstill.”

The prosecution classified this broadcast as an act of terrorism under section 1(2)(b) of the Terrorism Prevention (Amendment) Act, 2015.

While reviewing the evidence, Justice Omotosho cited video recordings submitted by the prosecution, noting that Kanu issued violent threats that demonstrated a clear intent.

“His intention was quite clear as he believed in violence. These threats of violence were nothing but terrorist acts, which were duly carried out by his followers. He was consumed by violence and didn’t mind if his own people died in the process. It is clear that the defendant carried out preparatory acts of terrorism,” the judge stated.

The court also observed that Kanu repeatedly declined opportunities to provide context for his broadcasts.

“Consequently, the defendant is hereby convicted with respect to count one,” Omotosho declared.

The court is continuing to deliver judgment on the remaining six counts against Kanu.

Alleged Terrorism: Court To Deliver Judgment In Nnamdi Kanu’s Absence After Outburst

Justice James Omotosho of the Federal High Court in Abuja announced on Thursday that the judgment in the trial of Nnamdi Kanu, the self-acclaimed leader of the Indigenous People of Biafra (IPOB), will be delivered in the defendant’s absence.

The ruling followed what the judge described as Kanu’s unruly behaviour during the resumed trial session earlier in the day.

Earlier, Omotosho had ordered that Kanu be removed from the courtroom after he disrupted proceedings midway through the session.

Prior to the removal, the judge had dismissed three fresh motions filed by Kanu, ruling them unmeritorious after the case had been adjourned for judgment.

As the judge prepared to deliver the scheduled ruling for Thursday, November 20, Kanu challenged the court, insisting it could not proceed because he had not filed his final written address.

During the outburst, Kanu raised his voice, accusing Justice Omotosho of bias and claiming that the judge did not understand the law.

Following the disruption, Kanu was moved out of the courtroom, allowing the judge to proceed with delivering the final judgment in his absence.
