The accused persons; Godwin Ukrakpor(70), Uche Esegine(22), Taiwo Omogoroye(42), Austin Osaikhuwuomwan(39) and Meshak Owuh 28) allegedly committed the offence at about 5am on July 1, 2017at sapele road, Benin city, while returning from all night.

They were charged in case Number MEV/251c/17.

Prosecution alleged that they acted in a manner that negligently caused the death of the 19 years old boy, Lucky Chukwuka who is a member of the redeemed Christian Church of God, Embassy Parish, Ugbowo, Benin city.

The accused persons’ plea was, however, not taken owing to the magnitude of the offence, punishable under sections 316 and 325 of the criminal code.

The presiding chief magistrate, Frank Idiake, declined jurisdiction over the matter and consequently remanded them in prison custody and referred their case to the State DPP for legal advice.
