Governor Ayodele Fayose of Ekiti State has written to the Economic and Financial Crimes Commission (EFCC) notifying the agency that he will make himself available to it on Tuesday, October 16, 2018.
In the letter personally signed by Governor Fayose, he said he was notifying the agency of his decision to make himself available to the EFCC “to clarify issue(s) or answer questions on issues within my knowledge.”
Fayose, in the letter dated September 10, and addressed to the chairman of the EFCC, said his desire to submit to the commission was hinged “on several and serial actions of your commission for some time now, including but not limited to freezing of my accounts and attempts to secure temporary forfeiture of my properties.”
He said these were “indicative of the commission’s desire to have me clarify some issues or answer some questions but for the immunity, I enjoy under Section 308 of the 1999 Constitution as the sitting governor of Ekiti State.”
Fayose stated in the letter: “I wish to inform you that my term of office pursuant to which I enjoy immunity against investigation and prosecution under the above provision shall lapse by effluxion of time on Monday, 15th October, 2018.
“As a responsible citizen of our great country, who believes in the rule of law, I wish to inform you of my decision to make myself available in your office on Tuesday, 16th October 2018 at 1pm to clarify issues or answer questions within my knowledge.
“Kindly confirm the suitability of the above date or indicate by return, the commission’s convenient date.”
A stamp on a copy of the letter, entitled “Notification of my decision to make myself available in your office to clarify issue(s) or answer questions on issues within my knowledge”, indicated that it was received in the office of the EFCC chairman on Tuesday, September 11, 2018.
Governor Fayose, who has been in a battle of wits with the anti-graft agency and had also been in and out of courts with the commission over his personal and state’s finances.
His tenure as governor of Ekiti State would elapse on October 16, when he is expected to hand over government to Dr Kayode Fayemi.
Postpone General Elections To Allow Zamfara APC Field Candidates — AGF Tells INEC
The Attorney-General of the Federation, Abubakar Malami (SAN), has asked the Independent National Electoral Commission to allow the All Progressives Congress in Zamfara State field candidates for the general elections.
Malami, who doubles as the Minister of Justice, made the call in a letter to INEC dated February 13 and made available to the News Agency of Nigeria.
The minister said that INEC could not foreclose the right of a political party to participate in elections without recourse to the Act.
He said: “My office received a petition from the firm of M. A. Mahmud, (SAN) & CO, in respect of the need to urgently consider Sections 38 and 39 of the Electoral Act and extend the time for the APC Zamfara to field a gubernatorial candidate in the light of a Zamfara High Court judgment in suit No.ZMS/GS/52/2018.
“The letter was requesting that the subsisting judgment in the suit be upheld and respected by INEC, as the Court of Appeal has upheld the appeal with No. CA/S/23/2019; thus effectively annulling the grounds upon which the purported cancellation of the APC Primaries in Zamfara by INEC was based.”
Malami in the letter invited INEC to comply with the judgment of the Court of Appeal by admitting the results of the APC Zamfara State primaries.
He also invited INEC to comply with the provisions of Section 38 of the Electoral Act, which empowers the commission to postpone the election for the governorship, National Assembly and House of Assembly elections.
He said this was in view of the fact that since the Court of Appeal had upheld the primaries as valid, the APC in Zamfara State would need a little time to catch up with its contemporaries in the election.
He said: “Granting them this concession is not necessarily a favour but a right that inures to all contestants under similar circumstances.”
The AGF maintained that by the doctrine and principle of judicial precedence, the appeal superseded the Federal High Court’s position which foreclosed APC Zamfara State from fielding candidates in the February and March general elections.
